The amendment to the Labor Code and Act No. 5/2004 Coll. on employment services, approved by the National Council of the Slovak Republic (parliament) on March 15, 2022, has modified the conditions of termination of employment of an employee with a disability by dismissal. Except in certain cases, the employer is required to obtain the prior consent of the competent Office of Labor, Social Affairs and Family to dismiss the employee with a disability.

Under the new legislation, the employer must notify without delay the employee with a disability of the application for prior consent. At the same time, the time limit for issuing the consent has been shortened, from the original 30 days to 7 working days from the date of submission of the application for prior consent. If the competent Office does not issue a decision within the time limit for processing the application, the legal fiction will apply, i.e., that it has issued a decision granting the employer consent to the termination of employment.

The new rules will enter into force on April 1, 2022.
