December 31, 2021 | News December 2021 | Suspended application of the new provision of the Labor Code

On December 15, 2021, the Constitutional Court of the Slovak Republic decided to suspend the application of the provision of the Labor Code which, with effect from January 1, 2022, should allow an employer to terminate the employment of an employee with notice once the employee reaches the age of 65 and the age determined for entitlement to a retirement pension.

The applicability of the provision has been suspended as there is concern that the planned date of its effectiveness could result in violation of employees’ rights.   

The Constitutional Court will still decide whether or not the provision in question is in conformity with the Constitution.
