{"id":1816,"date":"2024-07-01T00:00:14","date_gmt":"2024-07-01T00:00:14","guid":{"rendered":"http:\/\/www.marek.sk\/?p=1816"},"modified":"2024-07-01T09:04:54","modified_gmt":"2024-07-01T09:04:54","slug":"july-2024-novela-zakonnika-prace","status":"publish","type":"post","link":"https:\/\/www.marek.sk\/sk\/july-2024-novela-zakonnika-prace\/","title":{"rendered":"J\u00fal 2024 | Novela Z\u00e1konn\u00edka pr\u00e1ce"},"content":{"rendered":"\n<p>D\u0148a\n1. augusta 2024 nadobudne \u00fa\u010dinnos\u0165 novela Z\u00e1konn\u00edka pr\u00e1ce, ktor\u00e1 dop\u013a\u0148a a\nprepracov\u00e1va ustanovenia o povinnosti dod\u00e1vate\u013ea slu\u017eby na \u00fazem\u00ed Slovenskej\nrepubliky vyplati\u0165 mzdu, ktor\u00e1 nebola vyplaten\u00e1 zamestnancovi zamestn\u00e1vate\u013eom,\nktor\u00fd je&nbsp; priamym subdod\u00e1vate\u013eom\ndod\u00e1vate\u013ea slu\u017eby.<\/p>\n\n\n\n<p>Povinnos\u0165\nsa vz\u0165ahuje len na mzdy za v\u00fdkon stavebn\u00fdch pr\u00e1c t\u00fdkaj\u00facich sa v\u00fdstavby, opr\u00e1v,\n\u00fadr\u017eby, prestavby alebo demol\u00e1cie budov, a&nbsp;len v&nbsp;rozsahu minim\u00e1lnej\nmzdy platnej v&nbsp;\u010dase v\u00fdkonu pr\u00e1ce zamestnancom. <\/p>\n\n\n\n<p>Z\u00e1konn\u00edk\npr\u00e1ce doteraz obsahoval obdobn\u00fa pr\u00e1vnu \u00fapravu len vo vz\u0165ahu k&nbsp;zamestnancom\nvysielan\u00fdm na v\u00fdkon pr\u00e1ce na \u00fazemie Slovenskej republiky. Od \u00fa\u010dinnosti novely\nsa t\u00e1to povinnos\u0165 bude vz\u0165ahova\u0165 aj na vn\u00fatro\u0161t\u00e1tne vz\u0165ahy.<\/p>\n\n\n\n<p>Dod\u00e1vate\u013e slu\u017eby m\u00f4\u017ee odoprie\u0165 vyplatenie mzdy, ak preuk\u00e1\u017ee, \u017ee pri v\u00fdbere priameho subdod\u00e1vate\u013ea postupoval s n\u00e1le\u017eitos\u0165ou starostlivos\u0165ou, t.j. mus\u00ed preuk\u00e1za\u0165, \u017ee vyvinul \u00fasilie, aby si vybral zmluvn\u00e9ho partnera, u ktor\u00e9ho nie je predpoklad, \u017ee mzdy zamestnancom nevyplat\u00ed. <\/p>\n\n\n\n<p>Dod\u00e1vate\u013e\nslu\u017eby tak bude povinn\u00fd napr. preveri\u0165, \u010di dohodnut\u00e1 cena za plnenie\nsubdod\u00e1vate\u013ea nie je bez ekonomick\u00e9ho opodstatnenia neprimerane n\u00edzka, \u010di\nsubdod\u00e1vate\u013e nem\u00e1 nedoplatky na daniach, soci\u00e1lnom a&nbsp;zdravotnom poisten\u00ed, in\u00fdmi\nslovami, \u017ee nejde o spolo\u010dnos\u0165, u ktorej mo\u017eno predv\u00edda\u0165 nevyplatenie mzdy. <\/p>\n\n\n\n<p>Dod\u00e1vate\u013e\nslu\u017eby v\u0161ak nebude m\u00f4c\u0165 odoprie\u0165 vyplatenie mzdy zamestnancovi subdod\u00e1vate\u013ea,\nak ku d\u0148u uplatnenia pr\u00e1va na vyplatenie mzdy nesplnil svoj splatn\u00fd pe\u0148a\u017en\u00fd\nz\u00e1v\u00e4zok za vykonanie pr\u00e1c vo\u010di subdod\u00e1vate\u013eovi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>D\u0148a 1. augusta 2024 nadobudne \u00fa\u010dinnos\u0165 novela Z\u00e1konn\u00edka pr\u00e1ce, ktor\u00e1 dop\u013a\u0148a a prepracov\u00e1va ustanovenia o povinnosti dod\u00e1vate\u013ea slu\u017eby na \u00fazem\u00ed Slovenskej republiky vyplati\u0165 mzdu, ktor\u00e1 nebola vyplaten\u00e1 zamestnancovi zamestn\u00e1vate\u013eom, ktor\u00fd je&nbsp; priamym subdod\u00e1vate\u013eom dod\u00e1vate\u013ea slu\u017eby.
