A draft amendment to Act No. 50/1976 Coll. on Land Use Planning and Building Code (Building Act) (the “Act”), recently approved by the Government, introduces a procedure for retrospective approval and legalization of buildings constructed without prior approval. If the amendment is adopted by the parliament, the retrospective approval procedure would enable the owners of unauthorized buildings to apply for retrospective approval within three years from the effective date of the new legislation. Any such buildings would, however, have to comply with the requirements under the new legislation, otherwise retrospective approval would not be granted. Under the proposed amendment, it would not be possible to seek retrospective approval for any new buildings constructed without first having obtained a building permit and the owners of such buildings would be required to remove them.
