June 28, 2023 | News July 2023 | The right to use cash enshrined in the Slovak Constitution

On June 15, 2023, the National Council of the Slovak Republic (parliament) approved an amendment to the Constitution, which enshrines the right to make payments in cash for goods and services. The aim of the amendment is to ensure that cash payments remain one of the available payment alternatives in the future.

At the same time, also the right to refuse payment in cash for reasonable or generally accepted reasons was added to the Constitution.

According to the proponents, recipients of payments should have the right to refuse cash, for example, in the cases where the recipient is not adapted to receive cash, or does not want to receive cash and applies this principle equally to all payers. Reasonable reasons should include also security reasons, e.g. elimination of the risk of robbery or theft, and technical reasons, e.g. in the case of a vending machine that is not equipped to accept cash payments.

However, such restrictions on receiving cash are excluded in the case of carrying out cash transactions in a bank or in a branch of a foreign bank.
