The amendment to the Public Procurement Act, effective as of 1 January 2019, removes some administrative problems of the previous legislation.

The first change is the introduction of a new category of contracts that is not covered by this Act. These are contracts with an estimated value of less than EUR 5000 per calendar year or during the term of the contract if the contract is concluded for more than one calendar year.

Another change is the increase in financial limits for civilian below-the-threshold contracts.

Also, references must include a public procurement label and a performance assessment, especially in terms of quality.

Under the amendment, any tenderer who has not drawn up the tender on their own is also required to indicate the person whose services or supporting documents he/she used in drawing up the tender.

While the contracting public authority used to be required to keep documentation for 5 years, from now on it will have to keep it for 10 years. The objection process has also been amended. Objections can be sent to the Public Procurement Office in paper form as well as in electronic form.
