In relation to the spread of the coronavirus pandemic, the National Council of the Slovak Republic (parliament) has adopted Act No. 66/2020 Coll., supplementing the Labor Code. The amendment entered into force on the date of its publication.

Under the amendment, during an extraordinary situation or a state of emergency and for a period of two months after their lifting, inter alia, the following provisions apply:

  • While measures to prevent the emergence and spread of transmissible diseases, or public health measures, implemented by competent authorities, remain in force:

(a) an employer may instruct an employee to perform work from home, provided the agreed type of work makes it possible,

b) an employee has the right to perform work from home, provided the agreed type of work makes it possible and there are no serious operational reasons on the employer’s part which make it impossible to perform work from home.

  • The employer is required to notify the employee of his/her work schedule for a week at least two days in advance, unless agreed with the employee on a shorter advance notice period.

If an employee cannot perform work, in whole or in part, due to his/her employer’s operations being suspended or restricted (i) pursuant to a decision of a competent authority, or (ii) due to an extraordinary situation or a state of emergency being declared, it is considered an obstacle to work on the employer’s part, and the employee is entitled to 80% of his/her average earnings, but not less than the statutory minimum wage.
