A substantial amendment to Act No. 311/2011 Coll., the Labor Code, becomes effective as of May 1, 2018.

Besides the changes regarding premium pay for work, which we have already outlined in our February news, the amendment introduces further important changes. Below we provide some of them.   

Temporary work in the territory of the Slovak Republic by employees of an employer established outside the EU/EEA

Under the amendment, an employee who is a third-country national and who is posted by his employer established in a third country to carry out work within the framework of the cross-border provision of services to the territory of the Slovak Republic will be afforded such labor-law protection as hitherto enjoyed only by employees from the Member States of the EU (e.g.  minimum wage, health and safety at work, length of leave, etc.).

A new duty for employers to disclose salaries in job offers

Employers will be required to state the amount of base salary in published job offers. In a subsequently concluded employment contract, it will not be possible to agree on the base salary that is lower than the one stated by the employer in the relevant job offer. In the event of failure to comply with these obligations, employers may face a high fine.

A certificate of employment given to an employee upon the termination of employment

The amendment simplifies the form of a certificate of employment (employment record; in Slovak: zápočtový list), which an employer is required to issue to an employee upon the termination of employment.
